Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Check My CoC platform (the "Service"), operated from the Republic of South Africa. By creating an account or using the Service, you agree to these Terms.
1. Definitions
- "Service" means the Check My CoC website, applications, and all related functionality.
- "You" or "User" means the person or entity that accesses or uses the Service.
- "CoC" means an electrical Certificate of Compliance issued under the Electrical Installation Regulations, 2009.
- "Report" means an automated assessment generated by the Service.
2. Eligibility and account
You must be at least 18 years of age and legally capable of entering into a binding contract. You agree to provide accurate registration information and to keep your password confidential. You are responsible for all activity carried out under your account.
3. Description of the Service
The Service performs an automated administrative review of CoC documentation based on configurable rules. It checks for completeness, internal consistency, and plausibility of the information you provide. It does not constitute legal advice, an opinion of an expert electrician, or a physical inspection of any installation. It is not a determination of legal compliance and may not be used as a substitute for the judgment of the Department of Employment and Labour or any registered person under the Electrical Installation Regulations.
4. Your responsibilities
- You confirm that you have the lawful right to upload each document you submit, including any personal information of third parties.
- You will not submit forged, manipulated, or knowingly inaccurate documents.
- You will not attempt to interfere with the Service, probe for vulnerabilities, scrape it, or use it to build a competing product.
- You will not use the Service for any unlawful purpose or in any way that infringes the rights of others.
5. Fees and payment
Pricing is published on the Pricing page and is payable in South African Rand (ZAR). Payment is processed by an independent payment service provider. By submitting a payment, you authorise the relevant charge. All fees are inclusive of VAT where applicable.
6. Refunds
The Service is an automated digital service that delivers an instant result. Once a Report has been generated and made available to you, the service has been rendered and the fee is generally non-refundable. We will consider a refund where you can demonstrate that the Report was not generated due to a technical failure on our side, or where a refund is required by South African consumer protection law (in particular section 44 of the Electronic Communications and Transactions Act and the Consumer Protection Act, where applicable).
7. Disclaimers and limitation of liability
The Service is provided "as is" and "as available". To the maximum extent permitted by law:
- We make no warranty that the Service will be uninterrupted, error-free, or that it will meet any specific requirement.
- A "compliant" or "appears compliant" outcome does not guarantee the physical safety of any electrical installation, the validity of any signature, or the current registration status of any electrician or contractor with the Department of Employment and Labour.
- We are not liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profit, revenue, data, or goodwill, arising from your use of or inability to use the Service.
- To the extent that liability cannot be excluded by law, our aggregate liability to you in any twelve-month period is limited to the fees you actually paid us in that period.
8. Indemnity
You agree to indemnify and hold harmless Check My CoC, its directors, employees, and agents against any claim, loss, or damage arising from (a) your breach of these Terms, (b) your unlawful or unauthorised submission of any document, or (c) your reliance on a Report in a manner inconsistent with these Terms.
9. Intellectual property
The Service, the Reports, and all related software, design, branding, and content are owned by us or our licensors and are protected by copyright and other intellectual property laws. You retain ownership of the documents you upload, and you grant us a limited licence to process those documents solely to provide the Service to you.
10. Suspension and termination
We may suspend or terminate your account at our reasonable discretion if we believe you have breached these Terms, are using the Service unlawfully, or pose a risk to the Service or other users. You may close your account at any time via the Account page.
11. Changes to the Service or these Terms
We may update the Service and these Terms from time to time. The "Last updated" date above will reflect the latest version. Material changes will be brought to your attention via the platform before they take effect, where reasonably possible.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of South Africa. You and we submit to the non-exclusive jurisdiction of the South African courts in respect of any dispute arising from or in connection with these Terms.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
